An 18-wheeler truck, which is one of the many types of accidents a Rosenberg truck accident lawyer handles
Legally Reviewed By
Michael E. Pierce

If you live in Rosenberg, Texas, you’re no stranger to sharing the road with massive 18-wheelers, big rigs, and other commercial trucks. Most of the time, we think of them as a nuisance, taking up space, blocking lanes, or slowing traffic on Highway 59.

A fully loaded semi-truck can weigh up to 80,000 pounds. That’s over 20 times heavier than your average car. So when a truck driver is careless, distracted, or pushing deadlines, the result isn't just an “accident”; it’s often a catastrophic event that can change a life forever.

At Pierce Skrabanek, we know how quickly everything can fall apart after a truck accident. The injuries, the stress, and the medical bills are a lot to face alone. That’s why our Rosenberg truck accident lawyers are here to stand by your side.

With more than $500 million recovered for injury victims in Texas and across the country, we bring real experience, real results, and real compassion to every case we take on. Contact our truck accident team today online or by calling (832) 690-7000.

“I was referred to Pierce Skrabanek Law Firm by my personal attorney, and from day one, I knew I was in good hands. The team was clear, honest, and constantly kept me updated on every step, from insurance and car repairs to the court process. What stood out most was how much they genuinely cared. I never felt like just another case. They were professional, empathetic, and truly went above and beyond. I’d recommend them to anyone dealing with a car accident. They actually care — and that makes all the difference.”

The Serious Reality of Truck Accidents in Rosenberg and Fort Bend County

While it can be difficult to find truck accident data specific to Rosenberg alone, we know that Fort Bend County, where Rosenberg is located, has seen a troubling number of serious commercial vehicle crashes. According to the Texas Department of Transportation’s 2024 crash statistics:

  • There were 5 crashes involving commercial vehicles in Fort Bend County, resulting in 5 fatalities
  • 55 suspected serious injury crashes were reported, with 67 hurt.
  • In total, there were 468 crashes on Fort Bend roads involving commercial trucks in 2024

One recent incident shows just how dangerous truck activity in Rosenberg can be. In April 2024, a 21-year-old man was tragically killed by an 18-wheeler at a loading dock on Commercial Drive. According to reports, the young man was moving wooden pallets when the semi-truck backed into the dock and struck him, resulting in fatal injuries.

Another devastating crash occurred recently at Highway 59 and Cottonwood Road, just outside Rosenberg. An 18-wheeler struck a Toyota Camry carrying four teenage girls. The crash killed one of the passengers and left two others with serious injuries requiring emergency air transport. The truck driver was uninjured.

Why a Rosenberg Truck Accident Attorney Is Needed for Complicated Trucking Cases

Unlike a typical passenger vehicle crash, truck accident claims are rarely simple. That’s because multiple companies may share responsibility for what happened.

When you're injured in a truck collision, identifying all potentially liable parties is key to maximizing your compensation. This is where an experienced Rosenberg truck accident lawyer knows how to uncover negligence, even when it's buried under several layers.

Depending on the circumstances, the following parties may be held responsible in a Rosenberg trucking accident:

  • The Truck Driver: If the driver was speeding, distracted, fatigued, intoxicated, or failed to follow traffic laws, they may be personally liable for causing the crash.
  • The Trucking Company: Employers can be held responsible for poor hiring practices, inadequate training, unrealistic delivery schedules, or failure to maintain the vehicle properly.
  • The Cargo Loading Company: Improperly loaded or unsecured cargo can shift during transit, leading to rollovers or jackknife accidents.
  • Vehicle or Parts Manufacturers: If a defective part, such as brakes, tires, or steering systems, contributed to the accident, the manufacturer may be held liable.
Each of these parties often has their own legal team and insurance provider working hard to protect their interests, not yours. That’s why truck accident cases require aggressive legal representation from a team that understands the complex web of liability and how to cut through it.

At Pierce Skrabanek, we prepare every truck accident case as if it’s going to trial. We thoroughly investigate what happened, consult experts when needed, and build strong, evidence-based claims that hold all negligent parties accountable. Start your free case review today by calling (832) 690-7000 or filling out our online form.

How Pierce Skrabanek Fought for Our Client After a Traumatic 18-Wheeler Accident

When an 18-wheeler slammed into Tuwanda’s vehicle, her life changed in an instant. In this video, she shares how the aftermath of the crash affected her physically and emotionally, and how attorney Michael Pierce and the team at Pierce Skrabanek helped her find justice:

The Role of Your Rosenberg Semi-Truck Accident Attorney

Truck accident claims are rarely straightforward. These cases are challenging and often stacked in favor of the trucking companies and their legal teams. That’s why having an experienced Rosenberg 18-wheeler accident lawyer on your side isn’t just helpful; it can change the course of your case.

Here’s how we work for you, from day one:

  • Conduct a comprehensive investigation of the crash scene.
  • Gather and preserve critical evidence, including the truck's black box data, driver logs, and maintenance records.
  • Work with accident reconstructionists and medical experts to show the full impact of your injuries caused by the accident.
  • Handle all communication with the at-fault parties and their insurance companies.
  • Prepare your case for trial from day one, so we are ready to fight for you in court if a fair settlement cannot be reached.

Trucking companies and their insurers don’t back down easily, but neither do we. At Pierce Skrabanek, we have decades of experience fighting for injury victims across Texas and nationwide.

Partnering with a Rosenberg truck accident attorney isn’t just about removing the legal weight from your shoulders.

A recent Martindale-Nolo study found that people who hired a personal injury lawyer received an average of $77,600 in compensation, compared to just $17,600 for those who went it alone. That’s more than four times the payout and a good reason to consider speaking with a lawyer about your options.

Frequently Asked Questions

How Long Do I Have to File a Truck Accident Claim in Rosenberg?

In Texas, you generally have two years from the date of the accident to file a personal injury claim, including those involving commercial trucks.

If you or a loved one has been injured in a truck accident, we recommend contacting our team at Pierce Skrabanek as soon as possible. We’ll walk you through your legal options, protect your rights, and make sure you don’t miss any important deadlines.

What if the Trucking Company Is Located Out of State?

It’s very common for trucking companies to be based outside of Texas, especially since many operate across state lines. However, that doesn’t limit your ability to file a claim, and it certainly doesn’t limit our ability to fight for you.

At Pierce Skrabanek, we represent clients across Texas and throughout the United States. We know how to handle the added complexities that can come with out-of-state defendants, including interpreting federal trucking regulations and multi-jurisdictional legal issues.

Can I Claim Compensation if a Loved One Was Killed in a Truck Accident in Rosenberg?

If you’ve lost a loved one in a fatal truck accident, certain family members may be eligible to file a wrongful death claim. While no amount of money can ever replace your loss, a claim can help you recover damages for loss of companionship, lost financial support, funeral and burial costs, and more.

What If I Was Partially at Fault for the Truck Accident in Rosenberg?

Even if you were partially at fault for the crash, you may still be able to recover compensation under Texas’s comparative negligence laws.

In Texas, the law follows a system called modified comparative fault. This means you can recover damages as long as you were less than 51% at fault. However, your compensation will be reduced by your percentage of fault. For example, if you’re awarded $100,000 but found to be 30% at fault, you would still receive $70,000.

$565,000 Settlement for 18 Wheeler Victim

Summary: Paul obtained a $565,000 settlement on behalf of Mary Berryman who was involved in a collision with an 18-wheeler in December 2010. The case was settled out of court at a second mediation the week before trial. Berryman filed suit against Jose Peralta and Scorpion Transport in Dallas County Court alleging that Peralta ran a stop sign and caused a collision with her truck. Peralta and Scorpion alleged that Berryman was in the best position to avoid the collision simply by going around him. Ultimately, Berryman, now 62, suffered a back injury that required her to undergo surgery. Peralta and Scorpion contended that the 62-year-old’s condition was related to a prior incident in 2007 where doctor reports showed herniations in her low back and neck. After the first mediation in the case, the mediator issued a mediator’s proposal, which was rejected by both parties. However, at a second mediation, the week before trial, the Defendants and their insurance carrier paid in excess of the first mediator’s proposal. Paul was the lead attorney on the case.
