How long do I have before I can no longer file a car accident claim in Texas?

Texas gives you two years from the date of the accident. That may sound like plenty of time, but between recovering from injuries, dealing with insurance companies, and getting back to some version of normal life, it can go faster than expected. Evidence also becomes harder to gather as time passes. Waiting is rarely in your favor.

The other driver is saying the accident was my fault. Does that mean I cannot recover anything?

Not necessarily. Texas follows a modified comparative fault rule, which means you can still recover compensation as long as you are found to be 50 percent or less at fault. If you share some responsibility, your compensation is reduced by that percentage. 

What matters is making sure fault is assessed accurately, because insurance companies have a financial interest in pushing as much of it onto you as possible.
